Terms of Service

1. About these terms

Rising Clips is a subscription service operated as a sole proprietorship based in Toronto, Ontario, Canada. In these terms, Rising Clips, we, us, and our refer to that operator, and the Service refers to risingclips.com together with the Rising Clips application and anything we make available through them.

By creating an account or using the Service you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. What the Service provides

Rising Clips is a research and education tool for musicians, producers, and the people who market them. We gather short-form videos that creators have posted publicly on platforms such as Instagram and TikTok, and we publish our own written analysis of the hooks, formats, and packaging decisions behind them. Your subscription gives you access to that library and to the tools we build around it.

3. Eligibility and your account

You must be at least 16 years old to use the Service. You agree to give accurate account information and to keep it current. You are responsible for keeping your password confidential and for everything that happens under your account. Tell us promptly at support@risingclips.com if you believe someone has used your account without permission.

Accounts are for one person. Sharing login credentials, or reselling or transferring access, is not permitted.

4. Free trial

We currently offer a three day free trial with full access and no credit card required. The trial is limited to one per person. We may withdraw, shorten, or refuse a trial at our discretion, including where we have reason to believe someone is creating multiple accounts to extend one. When the trial ends, access stops unless you start a paid subscription.

5. Subscriptions, billing, and renewal

Paid plans and their prices are shown at checkout. All prices are stated and charged in United States dollars (USD). Applicable sales taxes may be added.

Payments are processed by Stripe. We do not receive or store your full card number. By subscribing you authorise us, through Stripe, to charge your payment method for the plan you selected.

Your subscription renews automatically at the end of each billing period, at the then current price for your plan, until you cancel. If a payment fails we may retry it and may suspend access until payment succeeds.

We may change prices. If a price change affects you, we will give you at least 30 days notice by email before it applies to a renewal, and you may cancel before then if you do not wish to continue.

6. Cancelling and refunds

You can cancel at any time from your account settings or the billing portal. Cancellation takes effect at the end of your current paid period, and you keep full access until that date.

We do not provide refunds or credits for partial billing periods, for time you did not use, or for periods already begun. This does not limit any rights you have under consumer protection laws that cannot be waived by agreement.

If you believe you were charged in error, contact us at support@risingclips.com within 30 days of the charge and we will review it.

7. Acceptable use

You agree not to:

  • share, resell, sublicense, or transfer access to your account
  • scrape, bulk download, or systematically copy the library or our analysis
  • republish or redistribute our analysis as your own product or service
  • reverse engineer the Service or attempt to circumvent access controls, rate limits, or payment
  • use the Service to break the law or to infringe anyone else rights
  • interfere with the operation, security, or availability of the Service

8. Our content, and content belonging to creators

The written analysis, ratings, taxonomies, page copy, design, and software that make up the Service belong to us and are protected by copyright and other laws. Your subscription grants you a personal, non exclusive, non transferable, revocable licence to access and use them while your subscription is active. You are free to apply what you learn in your own creative and commercial work. You may not redistribute the library itself.

The videos shown in the Service were posted publicly by their creators on third party platforms. Those creators keep all rights in their videos. We display them alongside commentary and analysis for the purposes of criticism, review, and education. We are not affiliated with, endorsed by, or sponsored by Instagram, TikTok, Meta, or ByteDance.

If you are a creator and you would like your video removed from the Service, email support@risingclips.com and we will remove it promptly.

9. No guarantee of results

The Service provides research, analysis, and opinion. It does not guarantee any outcome. We make no promise that using Rising Clips will increase your views, followers, streams, sales, or revenue. Any examples shown are illustrative and are not typical or promised results. Decisions you make about your own music and marketing remain yours.

10. Availability and changes to the Service

We work to keep the Service available and accurate, but we do not guarantee uninterrupted or error free access. We may add, change, suspend, or remove features. To the fullest extent permitted by law the Service is provided on an as is and as available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or lost goodwill, arising out of or relating to the Service.

Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or fifty United States dollars (USD 50).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your use of the Service in breach of these terms or of applicable law.

13. Suspension and termination

You may stop using the Service at any time by cancelling your subscription and closing your account. We may suspend or terminate your access if you breach these terms, if payment is not made, or if we are required to do so by law. When your access ends, your licence to use our content ends with it. Sections that by their nature should survive termination will survive, including sections 8, 9, 11, 12, 15, and 16.

14. Changes to these terms

We may update these terms. If a change is material we will give you at least 30 days notice by email or within the Service before it takes effect. Continuing to use the Service after the effective date means you accept the updated terms. If you do not accept them, you can cancel.

15. Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent.

We may assign, transfer, or novate these terms, and our rights and obligations under them, in whole or in part, without restriction. This includes assignment to an affiliate, to a corporation or other entity formed or acquired to operate the Service, and assignment in connection with a merger, acquisition, reorganisation, or sale of assets. We will tell you if the party providing the Service changes.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of law rules. The courts of Ontario have jurisdiction over any dispute, subject to any right you may have under mandatory local law to bring proceedings where you live.

17. General

These terms, together with our Privacy Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. Nothing in these terms creates a partnership, agency, or employment relationship.
